Letter of disclaimer / declaration

 The GTR Club Europe or the organizer cannot be held liable neither under nor besides contractual obligations, for any kinds of damages caused by participants or himself or third persons in connection with the above mentioned event except such damages resulting of wilful or gross negligent acts of the GTR Club Europe /organizer.

 It is understood that no objections can be risen against any persons assisting the organizer provided that no claims are justified against the organizer himself. The participants shall indemnify and keep the organizer harmless in case of any claims of third parties as a result of any kinds of accidents. In the event that an insurance company does not have to regulate any kind of damage but is still able to hold a participant liable due to legal requirements, this is beyond the responsibility of the organizer/ GTR Club Europa 

The participants are aware that

a) they are driving at their own risk even if they follow the tour guide

b) the participation requires a minimum level of experience and sufficient physical constitution

c) the participation can be dangerous and that it involves the risks of falling and injury

d) they are not obliged to drive any passages which are or seem to bee too difficult

 The participants expressly declare that

a) they have arranged for proper insurance covering public liability, accidents and medical care themselves

b) they possess a valid driver's licence

c) they are in good physical and psychological condition and have sufficient driving experience

d) they have carefully read through and understood the above text concerning the enrolment.

 Should one or several of the terms and conditions of this declaration be or become null and void this will not affect the validity of its other terms and conditions. The contractual partners are obliged to replace void terms by valid ones if this does not lead to major alterations of the contents of the contract in general. The participation in the event bears risks. The participants declare with their registration that they participate at their own risk. They accept civil and criminal prosecution for all kinds of damages caused by themselves and their motor cycles (e. g. damages to persons, objects and consequential damages). In case the driver is not the owner of the motor cycle used during the event, he also relieves the persons mentioned in the above disclaimer from any kinds of claims for and on behalf of the owner of the vehicle.

 By registering for the the 8.GTR rally , a contract is made with the hotel, not with the GTR Club Europe or the organiser.

Haftungsausschluss Teilnahmebedingung

 Der GTR Club Europa bzw. der Organisator haftet weder vertraglich noch ausservertraglich für irgendwelche Schäden, die vom Teilnehmer verursacht werden oder ihm oder Dritten im Zusammenhang mit der GTR - Rally entstehen, es sei denn er handelt vorsätzlich oder grob fahrlässig.

 Wenn keine Ansprüche gegen den GTR Club Europa oder den Organisator selbst bestehen, können Ansprüche auch nicht gegen Erfüllungsgehilfen desselben geltend gemacht werden. Der Teilnehmer stellt den Organisator von Ansprüchen Dritter aufgrund von Unfällen frei.

 Dem Teilnehmer ist bekannt, dass

a) er auf eigenes Risiko fährt, auch wenn er dem Tourguide folgt,

b) ein Mindestmass an Erfahrung und körperlicher Konstitution erforderlich ist um mitfahren zu können,

c) das Fahren gefährlich sein kann und Sturz- und Verletzungsrisiko für sich und andere mit sich bringt,

d) er keine Passagen, die ihm zu schwierig sind oder erscheinen, fahren muss.

 Der Teilnehmer erklärt ausdrücklich,

a) für ausreichenden Haftpflicht-, Unfall- und Krankenversicherungsschutz selbst gesorgt zu haben,

b) im Besitz einer für ihn gültigen Fahrerlaubnis zu sein,

c) bei guter gesundheitlicher Verfassung zu sein und über ausreichend Fahrerfahrung zu verfügen,

d) den vorstehenden Text zur Anmeldung sorgfältig gelesen zu haben.

 Sollten eine oder mehrere der vorstehenden Bestimmungen dieser Erklärung unwirksam sein oder werden, wird dadurch die Wirksamkeit der Erklärung im übrigen nicht berührt. Die Vertragspartner verpflichten sich, die unwirksame Regelung durch eine wirksame Regelung zu ersetzen, sofern dies keine wesentliche änderung des Vertragsinhaltes bedeutet.

Die Teilnahme an der Veranstaltung ist mit Risiken behaftet. Der Teilnehmer erklärt durch seine Anmeldung, dass er an der Veranstaltung auf eigene Gefahr teilnimmt. Er übernimmt die zivil- und strafrechtlichen Folgen für alle von ihm und seinem Motorrad verursachten Schäden (z.B. Personen-, Sach- und Folgeschäden). Soweit der Fahrer nicht selbst Kfz-Eigentümer und -Halter des von ihm bei der Veranstaltung benutzten Motorrades ist, stellt er den im Haftungsverzicht genannten Personenkreis auch von jeglichen Ansprüchen des Kfz-Halters und -Eigentümers frei.

 Durch die Anmeldung zur 8. GTR - Rally 2009 entsteht ein Vertrag mit dem Hotel, nicht mit dem GTR Club Europa oder dem Organisator.

Exclusion de responsabilité

 Le GCE ou l'organisateur ne répond en aucune façon pour de dégâts quelconque, qui pourraient être causés par le participant ou qui pourraient lui être causés par de tiers lors du GTR-Rallye, sauf s'il agit exprès ou par négligence.

 Si aucune revendication ne peut être faite à l'égard du GCE, ceci compte également pour ses collaborateurs.

Le participant décharge l'organisateur de revendications de tiers, suite à un accident.

 Le participant a pris connaissance de ce que

a) il roule sous sa propre responsabilité, même s'il suit le guide.

b) un minimum d' expérience et condition physique est nécessaire pour participer

c) rouler comporte des dangers et un risque de chutes et blessures pour lui et autrui.

d) il n'est pas obligé de rouler des passages qui lui sont ou semblent trop difficiles

 Le participant confirme expressément qu'

a) il est suffisamment couvert en assurance responsabilité civile, accident et caisse maladie

b) il est muni du permis de conduire de la catégorie requise

c) il est en bonne santé et possède suffisamment d'expérience de conduite

d) il a lu attentivement le texte si dessus au moment de son inscription

 Si une ou plusieures conditions de ce qui précède ne seraient inefficace, ceci n'entame pas sa valeur. Les partenaires du contrats s'engagent de remplacer la condition inefficace par une valable à condition que cela n'entame pas le sens du contrat. La participation de l'événement comporte des risques. Le participant confirme par son inscription qu'il participe à ses propre risques. Il accepte les suites civiles et juridiques pour tous les dégâts causés par lui et son motocycle (dégâts corporels, matériels ou de suites). Si le conducteur n'est pas lui-même propriétaire du véhicule utilisé lors du Rallye, il libère l'organisateur également de revendications quelconques de la part du propriétaire.

 Par l'inscription du 8. GCE-Rallye vous concluez un contrat avec l'Hâtel, et non pas avec le GCE ou l'organisateur.
